Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
Categorical Exemptions 15304(b) Minor Alterations to Land and Section 15061(b)(3) General Rule Exemption.
Reasons for Exemption
The proposed project is categorically exempt from the provisions of the CEQA Guidelines pursuant to the Provisions of Title 14 of the California Administrative Code, Section 15304 (Minor Alterations to Land) because it involves a minor alteration to the condition of land and vegetation that would not involve the removal of healthy, mature, or scenic trees. The project would involve seasonal cultivation in above-ground pots in two existing cleared areas no grading, construction of new buildings, or placement of impervious surfaces would occur. The proposed activity is also exempt under the common-sense exemption, Section 15061(b)(3), because it can be seen with certainty that there is no possibility that the activity in question could have a significant impact on the environment. No exceptions listed under Section 15300.2 apply.
