Text changes to Title 19 (Kern County Zoning Ordinance) Chapter 19.22 (High Density Residential) and Chapter 19.80 (Special Development Standards) to implement State housing regulations related to the requirement to plan for the County’s Regional Housing Needs Allocation. Approved amendments include the following: a) Amending Chapter 19.22 (High density Residential to include a required minimum density of 20 dwelling units per acre, where-as no previous minimum density was required. b) Amending Chapter 19.80 (Special Development Standards) to include: i. fencing along the outside boundary of multifamily developments of 5 dwelling units or more, in a Type A or Type B Improvement area. ii. additional screening requirements for multifamily developments of 3 dwelling units or more, when constructed adjacent to certain residential zone classifications.

Reasons for Exemption
The approved text amendments to the Zoning Ordinance will implement programs 2.2.2 and 2.2.3 of the Kern County Housing Element Update (2015-2023) and will bring the County into compliance with state housing law. The minimum density would apply to land that is currently zoned R 3 (High density Residential) ¬and was analyzed at a maximum density of 29 dwelling units per acre and found to be compatible with surrounding land uses. Implementing a minimum density would not change previous determinations about compatibility due to it not representing a “most intensive allowed use” scenario. Land that currently has a zone classification of R-3 (High Density Residential) could have been built out at a density of 20 units per acre by-right. The proposed textual changes help to ensure that land classified as R-3 (High Density Residential) is built out at a density that has been identified and analyzed to meet the County’s housing needs.
