The project is exempt by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is NOT subject to CEQA. In this case, the request for modification to the CUP No. 7-06 and amendment of the DA No. 02-06 for the Reliance II Landfill site terminates the Applicant’s rights and obligations under the CUP No. 7-06 and DA No. 02-06, and therefore, there is no potential for an effect on the environment.
