Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
§ 15301, § 15302, and § 15303
Reasons for Exemption
Board staff has determined the project is exempt from CEQA under the Class 2, Replacement or Reconstruction, and Class 3, New Construction or Conversion of Small Structures categorical exemptions (CEQA Guidelines §15302 and §15303, respectively), because the activity consists of the removal and replacement of existing utility poles and overhead power lines, and the construction of a limited number of underground utilities and accessory utility equipment. In addition, the project qualifies under the Class 1, Existing Facilities categorical exemption (CEQA Guidelines §15301), for the permitting/authorization of three existing poles. Further, none of the exceptions to the exemption in CEQA Guidelines Section 15300.2 apply. Please note, the signed NOE is not attached. If you would like to request a signed copy of the NOE, please contact Board Staff at:
