Reasons for Exemption
Class 3 of section 15303 New Construction or Conversion of Small Structures provides for the construction and location of limited numbers of new, small facilities or structures including but not limited to one single family residence or a second dwelling unit in residential zone. Class 3 also provides for the construction of accessory (appurtenant) including but are not limited to garages, carports, patios, swimming pools, and fences. The proposed project includes the construction of a covered patio, outdoor fireplace, pool and spa, and landscaping, which are allowable types of accessory structures to be constructed at a residential property under section 15303(e). No new dwellings are proposed with this project. The accessory structures are designed consistent with the city's zoning code and local coastal program implementation plan with regard to location, setback, height, water quality, hazards, and public access.
