Document Description
A Resolution of Necessity to acquire property interests in APNs 0399-261-01 and 0399-261-08. According to the Caltrans Bridge Inspection Report (BIR) dated February 2014, the Bear Valley Road Bridge is functionally obsolete and structurally deficient. Also, the bridge does not currently meet geometric or structural standards set by the American Association of State Highway and Transportation Officials or design standards within the Town’s General Plan; including the Town’s plan for bike and pedestrian facilities. The project is needed to eliminate documented deficiencies and to meet current standards. To reconstruct the bridge, temporary access to the river is necessary from the south and the north side of the existing bridge. Space adjacent to the bridge is necessary to temporarily set up and operate heavy equipment, such as cranes, while maintaining adequate clearance to the public. A permanent sidewalk is necessary along the south side of the bridge to close the gap between existing sidewalks approaching the bridge. In accordance with the California Environmental Quality Act (Pub. Res. Code, § 21000 et seq. [CEQA]) and the State CEQA Guidelines (Cal. Code Regs., tit. 14, § 15000 et seq.), the rehabilitation and widening of the Bear Valley Road Bridge and roadway, bike lane and sidewalk improvements were previously analyzed in the 2017 MND and 2020 Addendum (together the “MND”). The currently proposed acquisition of one permanent and two temporary easements are necessary to implement this project. Under State CEQA Guidelines section 15162, when an EIR has been certified or a negative declaration adopted for a project, no subsequent environmental review is permitted unless one of the conditions described in section 15162 are present. Here, the Town determined that none of these conditions are present because no substantial changes are proposed that would result in new significant environmental effects or a substantial increase in the severity of previously identified significant effects; no substantial changes have occurred with respect to the circumstances under which the project is undertaken; and no new information of substantial importance shows that the project would have one or more significant effects not discussed in the prior environmental review. Thus, the Town has determined that no subsequent environmental review is required.
