Document Description
This Agreement relies on the Notification materials and a desk review without a CDFW site inspection. The project is limited to 12 encroachments (Table 1) to upgrade failing and undersized stream crossings. Work for these encroachments will include excavation, removal of the failing crossings, replacement with new properly sized crossings, backfilling and compaction of fill, and rock armoring as necessary to minimize erosion. Crossing-1 40.4603, -123.7152 Replace failing culvert with minimum 30-inch diameter culvert. Install rock armor at the culvert inlet and outlet. Crossing-4 40.4598, -123.7138 Recently installed 24-inch diameter culvert without an LSAA. Permittee shall ensure that the crossing complies with the terms of this Agreement. Crossing-5 40.4592, -123.7141 Replace existing culvert with minimum 30-inch diameter culvert. Install rock armor at the culvert inlet and outlet. Crossing-6 40.4576, -123.7164 Existing 36-inch diameter culvert. Install rock armoring at culvert outlet to prevent erosion. Crossing-7 40.4571, -123.7164 Existing rocked ford. Replenish rock and monitor erosion. No vehicle use is authorized when the crossing is wet. Crossing-8 40.4579, -123.7172 Existing rocked ford. Replenish rock and monitor for erosion. Crossing-13 40.4594, -123.7134 Recently installed 24-inch diameter culvert without an LSAA. Permittee shall ensure that the crossing complies with the terms of this Agreement. Crossing-14 40.4607, -123.7132 Existing 24-inch diameter culvert. Clear culvert outlet and install rock armoring as appropriate to prevent erosion. Permittee disclosed: • Crossing-2 Lat/Long; 40.4618, -123.7137 • Crossing-3 Lat/Long; 40.4609, -123.7134 The Notification states these stream crossings are in good condition and meeting current performance standards. Existing stream crossings disclosed in the Notification, but not included as 1602 projects with fees, are not covered under this Agreement. If maintenance (such as armoring) and/or replacement become necessary, that work must be covered by a major amendment or a separate Notification. The Notification also discloses the use of a well located at Lat/Long 40.4570, -123.7205. This well is presented as the sole source of water for all needs on the property. CDFW did not evaluate hydraulic connection of the well to surface water, nor was a hydrogeologic evaluation prepared by a licensed geologist provided for CDFW review. Based on the available resources, and the site inspection, the well may be hydraulically connected to streams and/or springs and shall be evaluated for potential impacts from commercial cannabis irrigation use through the County’s cannabis cultivation permit (PLN-10888-CUP). If it is determined that the well is impacting surface water, the Permittee shall notify for the well. No other projects that may be subject to FGC section 1602 were disclosed. This Agreement does not retroactively permit any constructed reservoirs (including “ponds”), stream crossings, water diversions, modifications to riparian buffers, or other encroachments not described in Table 1.
