Document Description
The project is limited to three encroachments. One encroachment is for water diversion from a pond at the head of a class III stream and associated spillway improvements of that pond. Water is diverted for irrigation. Work for the water diversion will include use and maintenance of the water diversion infrastructure. The existing 18-inch diameter pond spillway culvert will be replaced will a minimum 24-inch diameter culvert. The historic micro-hydro-electric infrastructure at the pond spillway will be removed. The second proposed encroachment is to upgrade a failing and undersized culvert. Work for this encroachment will include excavation, removal of the failing culvert, replacement with a new properly sized culvert, backfilling and compaction of fill, and rock armoring as necessary to minimize erosion. The third encroachment is to restore the flow of a class III stream back into its original channel by blocking the diverted path and clearing litter accumulation in the original channel. The applicant has disclosed an off parcel water diversion (shared by several adjacent parcels) located at 40.2290, -123.7312. This off parcel water diversion is not currently covered by an existing Agreement but CDFW anticipated that the property owner of this water diversion (APN 223.124.001) will notify the department, pursuant to FGC section 1602. The anticipated Notification will cover all diversions from that POD, including use of this project parcel.
