Reasons for Exemption
Public Resources Code Section 21083.3 and CEQA Guidelines Section 15183 provide that a proposed project that is consistent with a "community plan" and/or existing zoning for which an EIR was certified is exempt from CEQA, "except as might be necessary to examine whether there are project-specific significant effects which are peculiar to the Project or its site." The Project is exempt because it is consistent with the City of Sacramento's zoning use and intensity designations for the project site as established by the Natomas Crossing PUD. The City certified an EIR (State Clearinghouse Number 2007112088) for the Natomas Cross PUD prior to adopting the zoning regulations therein . After review of the Project and the certified EIR, the City determined that the Project would not result in any significant impacts that: (1) are peculiar to the Project or its site; (2) were not identified as significant in the certified EIR; or (3) were previously identified significant effects but that would have a substantial increase in severity as compared to the certified EIR. Therefore, the Project is exempt from CEQA.
