Document Description
The Fifth Amendment to International Transportation Service, LLC's Preferential Assignment Agreement (PAA) HD-7048 with the Port of Long Beach sets forth the terms for construction and financing of improvements to fill the existing slip between Berths G232 and G236 and construction of a pile supported concrete wharf connecting the two berths to create Berth G234 resulting in approximately 19 acres of lands and 565 linear feet of wharf; extends the term of the PAA through August 31, 2051; establishes the Guaranteed Minimum Annual Compensation (GMAC) and breakpoint for the period from September 1, 2026 through August 31, 2031; requires letters of credit in an amount equal to 24 months of forward -looking GMAC beginning no later than September 1, 2026 and release of the existing guaranty; replaces existing environmental covenants to meet the Port of Long Beach current environmental standards; and adjusts the insurance requirements, including requirements for construction of the slip fill improvements. The Fifth Amendment to PAA HD-7048 is a subsequent approval within the scope of the EIR for the Piers G and J Terminal Development Project certified and Harbor Development Permit No. 00-007 issued by the Board of Harbor Commissioners on September 11, 2000.
