Proposed AB 901 Recycling and Disposal Reporting System Regulations

Description

In 2015, the Legislature enacted AB 901 (Stats. 2013, Ch. 746; Public Resources Code§§ 41821.5- 41821.8), which changes how disposal and recycling is reported to CalRecycle. Prior to the passage of AB 901, only disposal information was reported to local jurisdictions who then reported to CalRecycle AB 901 changes this format by having disposal reporting directly to CalRecycle. AB 901 also expands reporting by requiring recycling and composting information to also be reported to CalRecycle. Under AB 901, waste, recycling, and compost facilities, as well as exporters, brokers, and transporters of recyclables or compost will be required to submit information to CalRecycle on the types, quantities, and destinations of materials that are disposed of, sold, or transferred inside or outside to the state. Cal Recycle also gains enforcement authority to collect this information. CalRecycle has developed a proposed regulation to facilitate reporting and to ensure that all information that AB 901 requires reported reaches CalRecycle.
