Title
Caltrans Statewide Variance for Reuse of Lead-Contaminated Soils
Description
The DTSC is proposing to issue a variance that would allow Caltrans, under specified terms and conditions, to excavate, stockpile, transport, and reuse soil contaminated with low levels of lead that may be encountered during highway improvement projects conducted within existing state-owned highway right of ways. These projects are individually subject ti additional environmental impact assessments as required by CEQA when Caltrans proposes and approves projects for detailed design and construction. The variance would waive the provisions of Chapter 6.5, Health and Safety Code (H&SC), and Title 22, California Code of Regulations (22 CCR), that would otherwise require Caltrans to obtain a hazardous waste disposal facility permit and to comply with various generator requirements that concern transportation, manifesting, storage and disposal of hazardous waste. The variance would be issued in accordance with H&SC section 25143 and 22 CCR section 66260.210.
