Description

The above described real property is identified in Humboldt County records as Assessor's Parcel Numbers 309-051-004 and 309-071-016 containing 113 acres, more or less. Based on a legal opinion obtained from the Office of Solicitor, Department of Interior, all subject parcels are contiguous to, and located adjacent to, the western side of the Rohnerville Rancheria. Pursuant to CFR 151.10, the following factors were considered in formulating our decision: (1) need of the tribe3 for additional land; (2) the purpose for which the land will be used; (3) impact on the State and its political subdivisions resulting from removal of the land from the tax rolls; (4) jurisdictional problems and potential conflicts of land use which may arise; (5) whether the Bureau of Indian Affairs is equipped to discharge the additional responsibilities resulting from the acquisition of the land in trust status; and (6) the extent to which the applicant has provided information that allows the Secretary to comply with the implementation procedures of the Department of the Interior, 516 DM 1-7, and 602 DM 2, Land Acquisitions: Hazardous Substances Determination.
