Title: POINTE ANAHEIM PROJECT
Description: The action which is the subject of this Notice of Determination is the approval of Amendment No. 4 to the Second Amended No. 4 to the Second Amended and Restated Development Agreement No. 99-01 (the "Amendment"), between the City of Anaheim and GardenWalk Hotel l, LLC, as it pertain to the construction of two hotels previously approved as part of the Pointe Anaheim/Anaheim GardenWalk Project ("GardenWalk Project"). The Amendment postpones the required construction start date and allows phased construction. The Amendment does not change the previously-approved development intensities for the GardenWalk Project. A Fourth Addendum to the previously-adopted Pointe Anaheim Initial Study/Mitigated Negative Declaration ("IS/MND") was prepared, considered, and approved in connection with the City's approval of the Amendment and to evaluate whether the GardenWalk Project could have any new or more severe potential environmental impacts beyond what was considered in the previously-adopted IS/MND for the previously-approved GardenWalk Project. The Addendum confirmed that none of the circumstances set forth in Section 15162 of the CEQA Guidelines was present and that no further environmental review is necessary.
