Document Description
On or about October 2024, the Oxnard Harbor District ("District") entered into a contract with AD Improvements for the demolition of Warehouse 1A as part of the Warehouse 1A Project ("Project"). During the demolition of Warehouse 1A, AD Improvements and Port Staff encountered an unforeseen emergency condition: potential sink holes behind the pendant wall on the Project underneath Warf 1. If swift action is not taken to repair the sink holes and install a secant wall, the integrity of the dock of Warehouse 1A and Wharf 1 will be compromised which will have the potential to stop all operation on the south terminal resulting in a huge loss of cargo movement and therefore public services. Port Staff determined that the present situation represents a sudden, unexpected occurrence that poses a clear and imminent danger, requiring immediate action to prevent or mitigate the loss of property. As such, the Project will undergo emergency repairs to Warehouse 1A and Wharf 1 and a secant wall will be installed to mitigate the clear and imminent danger cause by the present sinkholes.

Reasons for Exemption
The proposed Project is statutorily exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines §15269(c) (Emergency Projects), which exempts specific actions to prevent or mitigate an emergency. Here, the project involves the emergency repairs to the area of Warehouse 1A , and Wharf 1, and the installation of a secant wall to mitigate the clear and imminent danger caused by the present sinkholes. Without immediate action, the integrity of the dock of Warehouse 1A and Wharf 1 will b compromised which will have the potential to stop all operation of the south terminal resulting in a huge loss of cargo movement and therefore public services.
Alternatively, the proposed Project is categorically exempt from environmental review pursuant to State CEQA Guidelines, §15301, Existing Facilities (Class 1). The Class 1 exemption allows, in part, for the repair of existing structures to meet current standards of public health and safety. Here, the Project proposes repairs to the area of Warehouse 1A and Wharf 1 and the installation of a secant wall, which are necessary to meet current standards of public health and safety and avoid any future risk. These repairs and installation will not expands the former use; they are merely to mitigate the current emergency situation. The District has also considered whether the proposed Project is subject to any exception to the Class 1 exemption, as set forth in State CEQA Guidelines section 15300.2 and found no exemption applies.
