The proposed project is located in the southwestern portion of the San Bernardino County, south of the Inland Empire Utility Agency’s (IEUA) Regional Plan No. 5 (RP-5). The proposed alternative discharge location is an existing discharge location located west of El Prado Road and south of Kimball Avenue.

Reasons for Exemption
The State CEQA Guidelines provide a series of categorical exemptions for projects that have been deemed to have minimal impacts on the environment. The proposed project is the transfer of tertiary treated wastewater currently delivered to Prado Lake, and potentially overflowing to the Chino Creek, being redirected upstream to the existing RP-5 discharge facility to Chino Creek. Since no new construction is required, this proposed project has been determined to have no potential to cause significant adverse effects on the environment and will ensure that future operations at RP-5 can be conducted effectively. Categorical Exemption Class 1 exempts “the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment...involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. (b) Existing facilities of both investor and publicly owned utilities used to provide electric power, natural gas, sewerage, or other public utility services.....” The proposed project has been determined not to have a potential to cause significant adverse environmental effects if it is implemented. Therefore, this proposed action is not forecast to cause any potential for significant adverse environmental impacts and qualifies with the requirements for Class 1 Exemption.
