Document Description
The Project implements and administers the Demand Side Grid Support (DSGS) program, which incentivizes dispatchable energy customer load reduction and back-up generation operations as on-call emergency supply and load reduction for the state’s electrical grid during extreme events. The purpose of the Project is to comply with AB 205 (Stats. 2022, ch. 61), which requires the CEC to adopt guidelines to implement and administer the DSGS program, and AB 209 (Stats. 2022, ch. 251), which expands program eligibility. The Project benefits the state’s energy users by expanding participation from clean resources supporting the strategic reliability reserve that can reliably respond during both slow-moving and sudden-onset grid emergencies that place strain on the state’s electrical grid.

Reasons for Exemption
The legislation (AB 205 and AB 209) identifies and defines the types of resources that are eligible to participate in the DSGS program, and the order in which these resources should be dispatched, as well as the circumstances that trigger the use of these reserved resources. The California Energy Commission has no discretion to define the program components. The Project effectuates voluntary participation of energy customers into the DSGS program and establishes procedures for incentive payments. The Project does not add to the use of energy generating resources established by AB 205 and AB 209, and therefore has no impact on the environment that is additional to the legislative impact or otherwise discretionary. Accordingly, the Project is not subject to the California Environmental Quality Act because of the "common sense" exemption under section 15061(b)(3) of Title 14 of the California Code of Regulations.
