Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement EPIMS Notification No. EPIMS-58778-R1, pursuant to Section 1602 of the Fish and Game Code to Doren Morgan. The activities described below (Project) are intended to remediate damages incurred to property and fish and wildlife resources resulting from an unauthorized change to bed, channel, or bank and diversion of Gratten Creek. Mr. Morgan has voluntarily offered to restore damage to the stream caused by a third party. Approximately 20 cubic yards of earthen fill material will be removed along up to 50 linear feet of stream bank where it was illegally placed, restoring connectivity to Gratten Creek. The material will be relocated to backfill the inlet of an excavated diversion ditch and the remaining ditch will be filled with the original earthen material distributed along its length. Any remaining excess earthen spoils will be relocated where it cannot re-enter the stream, graded to no more than one-foot depth, and blended to match surrounding topography.

Reasons for Exemption
The Project consists of activities intended to remediate Fish and Game Code violations and consists of reconstruction of previously existing hydrological features. All instream work will be performed during dry weather during low or no stream flow. Erosion control best management practices will be applied as appropriate throughout the project site.
