Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Profession Code, Division 10, Chapter 2, Section 26012, approved a Medium Outdoor commercial cannabis license and a Cannabis Distribution license. The Project will consist of an outdoor cannabis cultivation operation with up to 43,560 square feet of mature canopy. Water is provided by an onsite well and a well on adjacent parcel 038-005-108-000 (owned by the licensee). Processing, packing and cannabis storage will exist within two 6,400 square foot agricultural buildings which will be constructed for this project. Cannabis distribution activities will occur within 1,384 square feet of one building.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is consistent with the local jurisdiction community plan and/or zoning designations. Calaveras County Board of Supervisors certified an Environmental Impact Report (EIR) for the Medical Cannabis Cultivation and Commerce Ordinance Project in January 2018. CEQA mandates that the project is consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified and shall not require additional environmental review, except as might be necessary to examine whether there are project-specific significant effects which are peculiar to the project or its site. The project activity fits within the parameters included in CEQA Guidelines Section 15183 and the activity does not require additional CEQA analysis.
