Document Description

Additionally, the proposed major grading is covered by the Emergency Projects Section 15269(a)(b)(c) of the CEQA Guidelines, as this project is to repair a facility damaged as a result of a disaster in a disaster-stricken area in which a state of emergency was declared by the Governor pursuant to the California Emergency Services Act. San Luis Obispo County was declared a disaster-stricken area as a result of the 2022/2023 storms. The storms damaged an impoundment facility on privately owned property that is necessary to maintain service essential to the public health, safety or welfare. Repairs are necessary to fix the problem and to prevent it from happening again.

Reasons for Exemption
This project is exempt pursuant to a Class 1 Categorical Exemption and the application of that Categorical Exemption is not barred by one of the exceptions set forth in Section 15300.2. The project consists of a request to repair an existing storm damaged surface irrigation impoundment with two retaining walls. While no biological resources were observed on site, pre-activity surveys and monitoring will be performed by a qualified biologist. Additionally, biological avoidance and minimization measures will be implemented as a part of the project. Proposed construction activities are located within a mapped blue line stream, jurisdictional permitting will be acquired for this work to occur. No cultural resources are anticipated to occur within the stream bed or bank. Furthermore, the areas proposed for repair have been previously disturbed. Based on these project characteristics, the repair of the surface irrigation impoundment is Categorically Exempt under Section 15301 (Class 1) of the CEQA Guidelines, which includes the repair and maintenance of existing structures and facilities.
