Reasons for Exemption
Prior to any action being taken for this request, the Planning Department staff have determined that the project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) and the City’s CEQA Guidelines. The project qualifies as a Class 1 exemption under State CEQA Guidelines Section 15301 – Existing Facilities which provide for negligible or no expansion of existing or former use. The project scope is to construct a 10-foot wall of which 4 feet will be retaining, for a total height of 8 feet pursuant to height standards for retaining walls as detailed in Development Code Section 17.48.030.A, and to reduce the street-side yard minimum setback for the proposed wall by 10%. The Planning Director has reviewed the Department’s determination of exemption, and based on their own independent judgment, concurs in the staff’s determination of exemption.
