Document Description
The California Department of Fish and Wildlife (CDFW) has executed Lake and Streambed Alteration Agreement (EPIMS-SBA-47827-R5), pursuant to Fish and Game Code (FGC) section 1602, to the project applicant, Canyon Produce, LLC. The project is the remediation of the FGC violations described in a Notice of Violation issued by CDFW. The project includes the replacement of culverts at two crossings, minor grading and recontouring of a stream to address erosion and bank failures, installation of erosion control blankets, installation of a stormwater conveyance system consisting of buried pipe within the cultivation fields, construction of an earthen drainage channel with a low water crossing to convey flows to a man-made pond, installation of water lines to supply well water to two ponds, and restoration of 3.98 acres of habitat.

Reasons for Exemption
The project meets the criteria for categorical exemption type Class 2; CCR, title 14, section 15302 because the project consists of replacement or reconstruction of existing structures. The new structures will be located on the same site as the structures being replaced and will have substantially the same purpose and capacity as the structures replaced. The project also meets the criteria for categorical exemption type Class 4; CCR, title 14, section 15304 because the project consists of minor alterations in the condition of land, water, and vegetation that do not involve removal of healthy, mature, scenic trees. Lastly, the project meets the categorical exemption type Class 33; CCR, title 14, section 15333 because the project consists of restoration less than five acres in size, will enhance habitat for wildlife, and will not impact endangered, rare or threatened species.
