Document Description
The Contra Costa County Flood Control and Water Conservation District (District) and BG Hay Barn, LLC. (Licensee) will enter into a License Agreement (Agreement) for Licensee to use the District-owned property located at 37 Alamo Square to allow for interim parking, outdoor dining, and landscaping purposes. The Licensee has a property adjacent to the District-owned property that does not contain sufficient area to operate the business of the restaurant for the patrons. The District-owned property was operating under a License Agreement that started in 1994 for these purposes, however, the Agreement was terminated when the property was sold to a previous owner in 2019. This new Agreement permits the Licensee to use District property for interim parking while requiring them to maintain the parking area, fencing, and paying rent. This Agreement will be effective for a 10-year term between March 1, 2025, and March 1 2035, unless otherwise terminated earlier by District or Licensee as per conditions set forth in the Agreement. Additionally, District and Licensee may extend the Agreement for an additional five years. This Notice of Exemption covers the Agreement between the District and Licensee only. The Licensee will be responsible to comply with applicable local, state, or federal regulatory environmental requirements associated with their operations described above, including any necessary CEQA documentation and applicable regulatory permits.
