Reasons for Exemption
PRC Section 21080.9 and CEQA Guidelines Section 15265 exempt local government from environmental review under CEQA in connection with its activities and approvals necessary for the preparation and adoption of a local coastal program and amendments thereto. The proposed Project is an approval of a local coastal program amendment, and thus is exempt from CEQA. Additionally, the Coastal Commission adopted a certified regulatory program containing the necessary environmental review for the Project (Public Resources Code Section 21080.5). Notwithstanding the foregoing, the City also prepared an addendum to the certified 2003 Coastal Land Use Plan/General Plan EIR to analyze potential impacts of this Project.
