Document Description
The current Agricultural Preserve/Williamson Act Contract (AGP 253) was entered into on February 6, 1973, and has been under a conservation agreement ever since. When defining the boundaries, the contract excepts a tract of land consisting of 1-acre. The grant deed describes a square parcel 209 feet on each side and a nonexclusive road and utility easement. A fence line and driveway were established in 1972 when the home was permitted to delineate the area under AGP 253 from the excluded parcel. However, this fence line does not accurately reflect the grant deed that established the excluded parcel. As a result, development over the past 50 years has been based on this misunderstanding, with the assumption that the location of the 1-acre excluded parcel aligned with the fence line.
