The San Bernardino County's Solid Waste Handling Franchise
Agreements were initially adopted by the Board of Supervisors on May 19, 1998 (Item No. 57) to provide affordable solid waste handling services that protect the health and safety of the community while establishing waste reduction and recycling programs
in compliance with the Integrated Waste Management Act of 1989 (Assembly Bill (AB) 939). In response to the California Short-Lived Climate Pollutant Act of 2016 (Senate Bill 1383), significant updates were made to ensure compliance with stricter standards for organic waste reduction and recycling. The most recent amendments, approved on April 8, 2025, include updates to County Franchise Areas (CFA) 16, 17, and 21 to address ongoing service operations and evolving regulatory requirements.
Amendment No. 1 to Agreement No. 22-1206 with Mountain Disposal Services, Inc. (CFA 16) allows subcontracting of solid waste handling services within the CFA 16 service area, includes language allowing the use of electronic signatures, revises and replaces exhibits within the contract, and adds a residential cart rate in the CFA 16A zone to provide a two-container collection service compliant with SB 1383. Amendment No. 6 to Agreement No. 09-612 with Big Bear Disposal, Inc. (CF A 17) updates the franchise area boundary map and legal description and renews the Proposition 218 notices to continue using the current amount rate
adjustment methodology and includes language allowing the use of electronic signatures. Amendment No. 8 to Agreement No. 09-616 with USA Waste of California, Inc. (CFA 21) renews the Proposition 218 notices to extend the current annual rate adjustment methodology and includes language allowing the use of electronic signatures. These amendments ensure continued compliance with state regulations while maintaining efficient and affordable solid waste management services throughout San Bernardino County.
