Document Description
The City of Ventura would restore an existing, City-operated notch within an exposed portion of its subterranean diversion dam on an as-needed basis, such that the intended function of the notch for fish passage is maintained. Key activities would include the clearing and redistributing up to 3,300 cubic yards of sediment within the floodplain and re-contouring a low flow channel to ensure fish passage at all flow conditions, including removing emergent plants that occur within the seasonally inundated portions of the then-current Ventura River low-flow channel. The project’s purpose is to restore the original function of the notch and fish passage at all flow conditions by clearing out sediment and cobble from the structure and the area upstream of it on an as-needed basis, up to a maximum frequency of once per year, though the work is not anticipated to be necessary in all years.

Reasons for Exemption
The proposed restoration of the existing notch as a fish passage, through debris removal on an up to annual basis, is consistent with “repair, maintenance…or minor alteration” of an existing public structure. Additionally, the project would not expand use of the notch; during operation, the notch would fulfill the same purpose as the existing system intended. Therefore, the project involves “negligible or no expansion of use.”
