Reasons for Exemption
The California Environmental Quality Act (CEQA) does not apply to the Commission’s review of the City of Long Beach’s Program Plan and Annual Plan, as the action does not constitute a discretionary approval. Alternatively, the Commission’s review and acceptance of the Plans is a normal, intrinsic part of ongoing Unit operations approved prior to CEQA’s enactment, and is statutorily exempt as part of an ongoing project. If considered discretionary, the action is also categorically exempt as pertaining to existing facilities, with no potential for any physical change in the environment or change to existing activities in the area. There is no reasonable possibility that the Commission’s review will have a significant effect on the environment due to unusual circumstances. Therefore, the action would not have a significant effect on the environment. As a nondiscretionary action, the above exemptions would apply only if it were determined, such as by a court, that the Commission’s action is subject to CEQA.
