Document Description
The proposed project includes the formation of a Community Facilities District pursuant to the Mello-Roos Community Facilities Act of 1982, to finance school facilities and the sale of one or more series of special tax bonds. Community Facilities District No. 2024-1 would be formed for the purpose of constructing and providing school facilities for the William S. Hart Union High School District, the planning and design work related thereto and incidental and related expenses to provide service to the residents within Community Facilities District No. 2024-1. In addition, Community Facilities District No. 2024-1 may finance other public facilities. Individual construction projects financed by Community Facilities District No. 2024-1 will be subject to independent review under the provisions of the California Environmental Quality Act prior to approval or construction.

Reasons for Exemption
This matter is exempt from the requirements of CEQA because the activity is not a “project” as defined under CEQA, as it can be determined with certainty that the formation of Community Facilities District No. 2024-1, together with the tax and bond authorizations and bond issuance and sales, will not have a significant effect on the environment (see 14 CCR section 15061(b)(3)); see also Kaufman & Broad – South Bay v. Morgan Hill (1992) 9 Cal.App.4th 464.) The Governing Board of the William S. Hart Union High School District has made such a finding in conjunction with the proceedings conducted in regard to the proposed formation of Community Facilities District No. 2024-1.
