Reasons for Exemption
Staff reviewed the approved project to determine the required level of review under the CEQA and determined the project to be Categorically Exempt from the CEQA pursuant to the following CEQA Guidelines: The project satisfies the requirements of CEQA Article 19 Class 2 § 15302 (Replacement or Reconstruction as the project will replace the existing sign. The replacement sign will be installed near the existing footprint and will be similar size/shape, and it will require minimal ground disturbance upon installation. Additionally, the foundation for the new sign is a 12-inch pole which is significantly smaller in size than the existing Welcome to Clearlake Foundation. Therefore, the sign is exempt from CEQA pursuant to Section 15302 (Class) Replacement or Reconstruction of Existing Facilities. The project satisfies the requirements of CEQA Article 19 Class 3 § 15303 (New Construction or Conversion of Small Structures) as it involves the installation of new facilities/structures within urbanized areas, where buildings will not exceed 10,000 square feet of floor area on sites zoned for such use. The footing/foundation of the sign will be 12-inch diameter pole and may go up to a depth of 10 feet below grade. City staff conducted a thorough review of all potential exceptions under CEQA Guidelines Section 15300.2 and determined that none would apply to the project. Specifically: (a) The project has no impacts and/or cumulatively significant impacts. (b) There are no significant effects due to unusual circumstances, as routine maintenance and/or removal of hazardous forest/fire fuels to reduce wildfire intensity and protect life and property from catastrophic events is a common practice within communities. (c) The project will not damage scenic resources, historic buildings, or rock outcroppings. Additionally, a records search indicated no known cultural or tribal resources/sites. (d) The project is not located on a hazardous waste site. (e) The project is designed to require minimal to no ground disturbance. Additionally, there are no known special circumstances that could reasonably result in the project having significant adverse environmental effects. As a result, the project satisfies the criteria outlined in CEQA Guidelines Sections 15304 and 15308 and qualifies as categorically exempt from CEQA requirements. No further CEQA analysis is required
