Reasons for Exemption
The recommended actions will not change nor alter anything physically for the Malibu Courthouse and will only change the terms of the joint occupancy agreement between the County and State. Therefore, approval of the proposed amendment do not constitute a project under CEQA because the proposed actions are not subject to the California Environmental Quality Act (CEQA) because they are activities excluded from the definition of a project by Section 21065 of the Public Resources Code and are organizational or administrative activity of government that will not result in direct or indirect physical changes in the environment pursuant to Section 15378(b) of the StateCEQA Guidelines (Guidelines). In the alternative, the activity is exempt pursuant to Section 1506l(b)(3) because it can be seen with certainty that the activity will not have a significant adverse impact on the environment.
