Document Description
The Department of Toxic Substances Control (DTSC) prepared a department-initiated permit modification for modifications to the Hazardous Waste Facility Permit Unit Specific Special Conditions and Special Conditions (Part V) language, specifically Unit 2 Special Condition No. 2 and No. 6, and Special Condition (Part V) No. 16 of the Permit. In addition, the definition for "Qualifying Storm Event" is clarified. On June 30, 2022, DTSC issued Hazardous Waste Facility Permit (Permit) for Lighting Resources, LLC (LRL) facility located at 805 East Francis Street, Ontario, California 91761. On May 1, 2023, LRL filed a petition for review of DTSC's permit decision with the DTSC Board of Environmental Safety (BES). As a result of the appeal and subsequent BES hearing, the BES directed DTSC to modify the Unit Special Conditions and Special Conditions related to the Permit further described in the Project Activities section below.

Reasons for Exemption
DTSC has determined none of the exceptions to the categorical exemptions apply to this project, as described in Public Resources Code § 21084(c), (d), and (e), and 14 CCR § 15300.2. The approval of the permit modification in accordance with the Settlement Agreement between LRL and DTSC is consistent with the actions taken by a regulatory agency, to assure the maintenance, restoration, enhancement, or protection of the environment by properly receiving, storing, and consolidating hazardous waste.
