Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Profession Code, Division 10, Chapter 2, Section 26012, approved a small mixed-light tier 1 commercial cannabis license. The Project will consist of up to 10,000 square-feet of mixed-light cannabis cultivation on 17.17-acres zoned as Rural Residential which allows for cultivation as long as other zoning conditions are met. The grading of the montane chaparral site occurred in 2020 and no further construction will occur. Water for the project would be municipal, particularly Trinity County Waterworks District No. 1. This site is serviced by the Hayfork Sewer District. Power is supplied by Trinity Public Utilities District. Access to the project site would be via a short driveway that connects to Kingsbury Road. The current garden consists of twelve 6 ft tall, by 6 ft wide, by 100 ft long (area 7,200 ft2) permitted primitive hoop houses with nine additional 6 ft x 60 ft (3,240 ft2) permitted primitive hoop houses. Natural Heal, LLC houses its immature plants on site in a 20 ft x 54 ft (1080 ft2) primitive hoop house which will be covered by a temporary structure permit. There is currently 9,936 ft² dedicated to mature plant canopy and 1,080 ft² dedicated to immature plants. The plants are grown in smart pots There will be two harvests per year. There is a 12 ft x 12 ft secured area dedicated to composting of organic cannabis waste located approximately 35 ft north of the cultivation area. There are three 8 ft x 40 ft shipping containers. Shipping container 1 has an 8 ft x 30 ft area dedicated to processing. The remaining 8 ft x 10 ft is used for administrative hold. The second shipping container also has an 8 ft x 30 ft area dedicated to processing with the remaining 8 ft x 10 ft used for harvest storage. Shipping container 3 is used for agricultural and pesticide storage

Reasons for Exemption
The Department of Cannabis Control has determined that the project is consistent with the local jurisdiction community plan and/or zoning designations. CEQA mandates that the project is consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified and shall not require additional environmental review, except as might be necessary to examine whether there are project-specific significant effects which are peculiar to the project or its site. The project activity fits within the parameters included in CEQA Guidelines Section 15183 and the activity does not require additional CEQA analysis.
