Document Description
The purpose of this Order is to to certify the U.S. Army Corps of Engineers, Sacramento District Regional General Permit 4 (RGP 4). RGP 4 authorizes work or structures within navigable waters of the U.S. and/or permanent or temporary discharges of fill material into waters of the U.S. associated with minimal impact activities and structures in Lake Tahoe. Direct impacts to waters of the state may include temporary fill activities such as temporary access points, staging locations, use of Best Management Practices, or permanent impacts such as placement of permanent structures in waterways. These activities may result in temporary impacts to water quality or may result in a permanent physical loss of lake bed area or permanent degradation of ecological conditions. To ensure that project impacts do not cumulatively cause adverse impacts to waters or interfere with compliance with water quality standards or objectives, this certification further defines and conditions the activities authorized in RGP 4. Activities covered under this Order include: Mooring Buoys; Fish Habitat Mitigation; Crayfishing Structures; Scientific Devices; Diver-Assisted Suction Harvesting, Laminar Flow Aeration, and Bubble Curtains; New Piers; Removed or Reconstructed Piers; Bulkheads or Static Revetments; Dynamic Revetments; Benthic Barriers; Removal of Previously Authorized Structures; and Maintenance Suction Dredging.

The RWQCB, Lahontan Region finds that this Order, as permitted, will not have a significant effect on the environment and shall, therefore, be exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to sections: 15304 Minor Alterations to Land, 15311 Accessory Structures, 15306 Information Collection, 15302 Replacement or Reconstruction, 15333 Small Habitat Restoration Projects, and 15301 Existing Facilities.
