Reasons for Exemption
This action is consistent with California Environmental Quality Act of 1970 (CEQA) and the State CEQA Guidelines, pursuant to Title 14, Cal. Code Regulations Section 15061 Review for Exemption (b)(3) pertaining to the Common Sense Rule. Pursuant to Section 15061(b)(3) of the CEQA Guidelines, a project is exempt from CEQA if the activity is covered by the Common Sense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Section 15061(b)(3) is applicable and appropriate for PPM 24-046 as the intent of the project is to draw an imaginary line with the purpose of splitting the site to match the existing zones and land use designations applied to the site with the adoption of Tulare County Ordinance No. 3052, Resolution No. 93-1083, to be consistent with the adopted Great Western Divide (North Half) Plan.
