Reasons for Exemption
Approval of emergency rulemaking to address ballast water discharge requirements will only cause a minor physical change in the environment and will implement more stringent requirements that are protective of the environment. The regulatory amendments will neither authorize construction activities nor relax standards allowing for environmental degradation. There is no reasonable possibility that the activity will have a significant effect on the environment due to unusual circumstances. Therefore, the project will not have a significant effect on the environment and the above categorical exemption applies.
