Reasons for Exemption
The proposed zoning code amendments are statutorily exempt from review under the California Environmental Quality Act (CEQA) pursuant to Section 15282(h) of the CEQA Guidelines (the adoption of an ordinance regarding second units in a single-family or multifamily residential zone by a city or county to implement the provisions of Sections 66310-66342 of the Government Code as outlined in Section 21080.17 of the Public Resources Code). Additionally, the adopted Ordinance amends ADU regulations and implements the goals, policies, and programs of the City of Arvin Housing Element and are regulatory actions taken by the city. Lastly, due to their limited impact, state law deems ADUs to be ministerial projects and, therefore, exempt from CEQA.
