Reasons for Exemption
The Class 1 Categorical Exemption consists of the operation, repair, maintenance,
permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The action merely involves a second amendment to the existing lease H D-9615 with Harmony Kiosk, LLC, extending the term of the lease for three years and adjusting the hours of operations. No other changes are proposed to the terms of lease HD-9615 or to the existing use of the premises; therefore, the second amendment to Lease HD-9615 would involve no expansion of existing use.
