Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Procession Code Division 10, Chapter 2, Section 26012, approved a retail cannabis license submitted on September 22, 2024, by OTC NC LLC. The Project will consist of a cannabis retail project in National City. The project will consist of minor upgrades to the existing HVAC system, which will include installing new filters to intakes and exhausts. The project will also consist of painting and signage, with no other exterior modifications.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is a Class 1 Categorical Exemption project. Class 1 Categorical Exemptions consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alterations to existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. The Department of Cannabis Control has also determined that the project is a Class 32 Categorical Exemption project. Class 32 Categorical Exemptions consist of projects characterized as in-fill development consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations; within city limits on a project site of no more than five acres substantially surrounded by urban uses; on a site that has no value, as habitat for endangered, rare or threatened species; would not result in any significant effects relating to traffic, noise, air quality, or water quality; and can be adequately served by all required utilities and public services. None of the exceptions to the exemption defined in Section 15300.2 apply to the Project.
