Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Procession Code, Section 26012, approved a Non-Storefront Retail commercial cannabis license submitted on 10/22/2024 by Regen West, Inc. The Project will consist of adding delivery-only (non-storefront) retail operations their cannabis manufacturing site on 115 Morris St. (APN: 004-011-030-000). The site is in the Industrial Zoning District and consistent with the city’s Zoning Ordinance. The site is on a 19,460 sq. ft. parcel and all current and proposed activities are within a 6,525 sq. ft. industrial building. Retail activities will occur in two secure rooms (total footprint: 144 sq. ft.) for product storage, loading/unloading operations, and sales. The ordinance to allow non-storefront retail stipulates that permits will only be granted to projects co-located in existing and active cannabis manufacturing facilities which the Project satisfies.

The Department of Cannabis Control has determined that the project is a Class 1 Categorical Exemption project. Class 1 Categorical Exemptions consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alterations to existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. None of the exceptions to this exemption defined in Section 15300.2 apply.
