Document Description
The California Department of Fish and Wildlife has executed Lake or Streambed Alteration Agreement EPIMS Notification No. EPIMS-MEN-52263-R1C, pursuant to Section 1602 of the Fish and Game Code to Redhawk Pallesen. The Project is limited to one (1) encroachment. One encroachment is for installation of a bypass structure on an onstream pond with a capacity of 0.75-acre feet, located on an unnamed tributary to York Creek. Work will include construction of a concrete diversion weir at the inlet with a removable flash board to allow bypass of 50% of the natural flow between December 15 and March 31, and bypass 100% of all the natural flow between April 1 and December 14. Bypass flows around the pond will be through a 3-inch diameter, 130-foot-long pipe. Work will also include the installation of a new 18-inch diameter outflow spillway culvert. Work for this encroachment will include excavation, installation of a new 18-inch outflow culvert, backfilling and compaction of fill, and rock armoring as necessary to minimize erosion.

Pallesen Pond Project (Project) meets the criteria for categorical exemption
type Class 2; California Code of Regulations, title 14, section 15302 because the project consists of replacement
or reconstruction of existing structures. The new structure will be located on the same site as the structure
replaced and will have substantially the same purpose and capacity as the structure replaced. The Project also
meets the criteria for categorical exemption type Class 4; California Code of Regulations, title 14, section 15304
because it consist of minor alterations in the condition of land, water, and vegetation that do not involve removal of
healthy, mature, scenic trees.
