Reasons for Exemption
In accordance with the· California Environmental Quality Act (CEQA), the recommended action is exempt from CEQA pursuant to State CEQA Guidelines, Section 15302 -Replacement or Reconstruction of Existing Structures [Class 2] because the Project replaces the existing, seasonal chair towers with new lifeguard towers on the same site and have substantially the same purpose and capacity as the replaced structures. The Project is also exempt pursuant to State CEQA Guidelines, Section 15303 - New Construction or Conversion of Small Structures [Class 3], in that the project consists of construction and location of limited numbers of new, small structures. Here, the project includes the installation of a new lifeguard tower on the sand. The new tower will be mounted on skids and will replace an existing, seasonal chair tower in the same location. Additionally, the Project is exempt from CEQA pursuant to State CEQA Guidelines, Section 15311- Accessory Structures [Class 11], in that the project consists of the construction, or placement of minor structures accessory to (appurtenant to) an existing institutional facility. The Class 11 exemption in particular provides, as an example, the placement of seasonal or temporary use items such as lifeguard towers. (State CEQA Guidelines, § 15311 (c).) Further, none of the exceptions outlined in State CEQA Guidelines section 15300.2 apply. The Project will not impact any sensitive habitat or protected/mapped environments. The Project will not result in a cumulative impact from successive projects of the same type in the same.place, over time, as staff does not anticipate any similar projects for Shaw's Cove, 9th or 10th street beaches in the future. Additionally, there are no unusual circumstances surrounding the Project that could result in the reasonable possibility of a significant effect on the environment because this Project is merely installing lifeguard towers in the same locations as the existing seasonal lifeguard towers and therefore does not represent a new or unique activity. The Project will not result in damage to scenic resources within an official state scenic highway, nor is the Project sitelocated on a site included on any list compiled pursuant to Government Code section 65962.5. Finally, the Project will also not cause a substantial adverse change in the significance of historical resources as there are no historical resources on or near the Project site. Consequently, additional environmental analysis is not necessary to meet the requirements of the CEQA.
