Reasons for Exemption
It can be seen with certainty that there is no potential for such ordinance to have a significant adverse effect on the environment pursuant to CEQA Guidelines Section 15061(b)(3). Section 15061(b)(3) of Title 14 of the California Code of Regulations states that CEQA applies only to projects which have the potential for causing a significant effect on the environment. The Amendments contained in the ordinance do not authorize construction and make minor changes to existing standards and land use limitations that apply to existing uses permitted in residential zones in the City and allow uses that are consistent with the residential uses currently permitted in such zones. Therefore, it can be seen with certainty that the draft ordinance has no potential to cause a significant effect on the environment and the Amendments are categorically exempt from further review under CEQA pursuant to Section 15061(b)(3), in addition to Section 15305 of Title 14 of the California Code of Regulations for minor alterations in land use regulations.
