Reasons for Exemption
In accordance with the California Environmental Quality Act (CEQA), the recommended action is exempt from further review per State CEQA Guidelines Section 15304 of the State CEQA Guidelines Minor Alterations to Land (Class 4), in that the project consists of minor alterations in the condition of land, water, and/or vegetation which do involve removal of healthy, mature, scenic trees. The Project will involve minimal disturbance to the overall landscape, including excavation of a small to moderate area of soil to accommodate the pool consisting of 60 cubic yards. These changes are localized and do not require substantial modifications to the Project site's use or the surrounding environment.
Additionally, the Project is categorically exempt pursuant to State CEQA Guideline Section 15303 - New Construction or Conversion of Small Structures (Class 3). Class 3 consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. Examples of this exemption Include but are not limited to, accessory structures including swimming pools. (State CEQA Guidelines, § 15303(a)(e).) Here, the Project includes a new pool, spa, deck, BBQ, and landscaping. The Project therefore falls within the Class 3 exemption as they fit within the examples provided and in fact are even smaller in scope than some of the other examples provided, such as the construction of a single-family residence.
None of the exceptions outlined In State CEQA Guidelines section 15300.2 apply. The Project site does not contain any environmentally sensitive areas that will be impacted as supported by the Coastal Hazards Analysis and Geotechnical Bluff'Edge Report. There will be no cumulative impact resulting from successive projects of the same type in the same place, over time in that the existing site and surrounding area is already developed. There Is no evidence of any unusual or special conditions that would result in a significant effect on the environment, which was supported by the analysis of a Coastal Hazards Analysis and Geotechnical Bluff Edge Report, as explained above. There will be no damage to scenic resources, including trees, historic buildings, rock outcroppings or similar resources, within a highway officially designated as a state scenic highway as they do not apply. A Historical Report was prepared, which determined there was no Impact on the historic residence and Its character-defining features and materials because the proposed Project will be separated and subordinate to the main residence and will be compatible with the historic character of the property. Thus, there will be no significant adverse impacts to historic resources. The Project is not located on a hazardous waste site, or any other site included on a list compiled pursuant to Government Code section 65962.6. Consequently, additional environmental analysis is not necessary to meet the requirements of CEQA.
