Reasons for Exemption
This action is consistent with Section 15061 (b)(3), The Common Sense Exemption, whereas the allowance to operate a Solid Waste Recycling Operation on a 1,500 square foot portion of a 15,000 square foot parcel, it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. This is because the use is compatible with the C-2-MU (General Commercial – Mixed Use) Zone, within the Earlimart Urban Development Boundary, with the Land Use Designation of General Commercial. Therefore, the application of CEQA Section 15061(b)(3) is applicable and appropriate for this project.
