Reasons for Exemption
This action is consistent with Section 15061 (b)(3), The Common Sense Exemption, whereas the allowance of above ground storage of a flammable liquid in excess of 10,000 gallons (total of four (4) – 12,000 gallon tanks), it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. This is because development of the project is located in the proper zone of C-2 (General Commercial), and the tank are regulated by the California Building Code and the California Fire Department to ensure personal and environmental safety. Therefore, the application of CEQA Section 15061(b)(3) is applicable and appropriate for this project.
