Reasons for Exemption
The adopted ordinance is also exempt pursuant to Section 15061(b)(3) of the CEQA Guidelines, on the basis that it can be seen with certainty that there is no possibility that the proposed amendments may have a significant effect on the environment, as they are consistent with how the City has regulated Family Day Care Homes since 2020. The adopted ordinance does not approve any land use entitlements for specific projects, and would permit uses that are deemed to be "by right" and non-discretionary by state law and not considered to constitute a "project" for the purposes of CEQA.
