Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Procession Code Division 10, Chapter 2, Section 26012, approved a Cannabis Retail License submitted on 04/30/2018 by Lupe Banda. The Applicant seeks to transition to an Annual Retail License to be located on an existing site located at 1320 E Edinger Avenue, Santa Ana, CA 92705. (Assessor’s Parcel Number 403-111-09). It will operate out of an existing 5000 SF on a lot area of 0.39 acres. The Project-Specific Information (LIC-4013-FORM) submitted by the Applicant states that existing structures will remain with no expansion proposed. Existing City sewer service is provided to the project site, and water is provided by the City of Santa Ana. Socal Edison provides electricity. The business was previously a restaurant. Operations would be from 5:30am-10:30pm.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is a Class 32 Categorical Exemption Project. Class 32 Categorical Exemptions consist of the environmentally benign infill projects that are consistent with the General Plan and Zoning requirements. This class is not intended for projects that would result in any significant traffic, noise, air quality, or water quality impacts. This exemption is not limited to any use type and may apply to residential, commercial, industrial, public facility, and/or mixed-use projects. None of the exceptions to the exemption defined in Section 15300.2 apply to the Project.
