Document Description
The project includes updates to the La Mirada Municipal Code (LMMC), Imperial Highway Specific Plan (IHSP), and Zoning Map to implement the goals and policies of the 6th Cycle (2021-2029) Housing Element and to bring the City's subdivision and zoning code into compliance with State Housing Law. The project also includes applying the Special Housing Overlay (SHO) Zone to 77 parcels and the Emergency Shelter Overlay (ESO) Zoning District to 12 parcels.

Reasons for Exemption
CEQA Guidelines Section 15162(a) – Subsequent EIRS and Negative Declarations:
When a Negative Declaration has been previously adopted, no subsequent EIR or Negative Declaration
shall be required unless new significant effects will result from the project or there is new information of
substantial importance that was not previously analyzed. The proposed amendments will implement the
policies of the Housing Element that was previously analyzed through an Initial Study/Mitigated Negative
Declaration (IS/MND) (SCH: 2023100427). There are no additional new residential sites, no additional
units, and no increase in density for housing beyond those analyzed in the Housing Element. The
proposed amendments and implementation procedures are not anticipated to result in any new changes
to the physical environment.
CEQA Guidelines Section 15061(b)(3) – General Rule/Common Sense Exemption:
Pursuant to CEQA Guidelines Section 15061(b)(3), a project is exempt from CEQA if the activity is
covered by the commonsense exemption, which states that “CEQA only applies to projects which have
the potential for causing a significant effect on the environment. Where it can be seen with certainty that
there is no possibility that the activity in question may have a significant effect on the environment, the
activity is not subject to CEQA.” The project implements existing State law, which will not result in a
change of regulations. Including the existing requirements into the City’s ordinance will not cause a new
significant effect on the environment.
