Reasons for Exemption
The Department of Cannabis Control has determined that the project is consistent with the local jurisdiction community plan and/or zoning designations. The City of Parlier certified an amendment to the City’s General Plan Environmental Impact Report (EIR) (State Clearinghouse # 2009011089) in 2009. In 2017 the Parlier City Council adopted Ordinance No. 2017-03, creating the City’s Cannabis Control Ordinance (Parlier Municipal Code [PMC] Chapter 18.55) and further amending the text of the PMC to allow commercial cannabis operations within the M-1 Manufacturing zone, subject to the provisions of the Cannabis Control Ordinance, along with other specified agricultural activities. The City of Parlier determined cannabis activity to be similar to other agricultural and commercial uses, and the City of Parlier determined that zoning to authorize such cannabis activities did not involve new, or increased severity of, significant environmental effects beyond those identified in the City’s General Plan and updates. CEQA mandates that the project is consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified and shall not require additional environmental review, except as might be necessary to examine whether there are project-specific significant effects which are peculiar to the project or its site. The project activity fits within the parameters included in CEQA Guidelines Section 15183 and the activity does not require additional CEQA analysis.
